Overnight parking ban








 Last month Niles City Council passed an overnight parking ban that prohibits parking vehicles on city streets between 2am and 6am. The body of the ordinance is posted below. We will not be issuing tickets for the first 90 days so that residents can get used to the change, A written warning only will be issued for violations during these 90 days.

SECTION ONE: No person shall park or leave a motor vehicle, trailer, boat, camper or other recreational vehicle on any street or alley within the City between the hours of 2:00 a.m. and 6:00 a.m. on any day, except emergency or public safety vehicles.

SECTION TWO: The Chief of Police or his designee is granted authority to issue
exemptions to the application of Section One of this ordinance. The exemptions are as follows:
(a) In the event that the residence of the owner of a motor vehicle has no off street parking or insufficient off street parking available for that motor vehicle, a permit may be issued for that vehicle to be parked at or adjacent to the residence of the permit applicant. The motor vehicle must be currently registered with the State of
Ohio at the owner's address before a permit will be issued. The' permit will be valid only until December 31st of the year in which it is issued. Thereafter, the owner must re-apply to the Police Department for a renewal of said permit.
{b}In the event of unusual temporary circumstances, such as driveway repairs or a family emergency or funeral, the owner of the property must contact the Police Department and receive permission for temporary overnight parking on the street
for specifically designated vehicles at or adjacent to the residence of the owner to expire on the date designated by the Police Department.
(c) Any permit issued by the Police Department must be displayed on the vehicle for which the permit was issued so that it is plainly visible from the outside of the vehicle by the Police Department. If the permit is not so displayed, the vehicle will be considered to be in violation of this Ordinance.

SECTION THREE:Any person violating this Ordinance shall pay the sum of $10.00 if the fine is paid within five days of the issuance of the Violation ticket. If not so paid within five days of its issuance, the violator must pay the sum of $20.00

"We do not create the ordinances but posted this to create some awareness for our residents. The "overnight parking ban" stops those who use the street as a parking lot/car storage area by leaving cars parked on the road for days/weeks at a time. It will also help our midnight shift officers spot suspicious cars parked in residential areas used by those who are committing crimes. These hours are peak times for the car break ins we have been experiencing during overnight hours. There are exceptions to the ordinance for those who do not have a driveway and/or are having a party/event. All you have to do is come down and get a permit if its ongoing street parking or call dispatch if it is and one night thing. There will be no charge for the permits according to the ordinance. The $10 fine will create no revenue for NPD as any fines go to the court. We also are writing no tickets for the first 90 days. That would not happen if revenue was NPD's goal. Hope this answers some questions."
